Dear Mr. Gunn:
Thank you for your correspondence of January 7, 2016, regarding the Trans Mountain Expansion Pipeline Project, currently under review by the National Energy Board (NEB).
I appreciate being made aware of your concerns with respect to the NEB process. As you noted in your letter, the Government of Canada is committed to making changes to restore public confidence in Canada’s environmental assessment processes for natural resource projects. This will include an interim strategy for projects currently under review.
During the NEB review of the Trans Mountain Expansion Pipeline Project, Transport Canada, along with other regulatory agencies, conducted a Technical Review Process of Marine Terminal Systems and Transshipment Sites (TERMPOL). The focus of the TERMPOL review process is on marine safety and accident prevention to help ensure that Trans Mountain can carry out the marine transportation components of the project in accordance with Canada’s regulatory regime and safety standards and industry best practices.
After reviewing Trans Mountain’s studies and taking into account its commitments, the TERMPOL Review Committee identified no regulatory concerns pertaining to the proposed undertaking. The TERMPOL review has been provided to the NEB for consideration as the Board reviews the proposed project.
As the NEB reports to the Minister of Natural Resources, I have taken the liberty of forwarding your correspondence to the Honourable Jim Carr, Minister of Natural Resources, for his consideration.
I appreciate the time you have taken to write to me on this important issue. The Government of Canada recognizes the importance of new infrastructure development and also that development must occur in a safe and environmentally sustainable manner.
